Terms of Service

Welcome to ResumePass. These Terms of Service ("Terms") govern your access to and use of the website resume-ats.online and all associated services (collectively, the "Service") operated by ResumePass ("we", "us", or "our").

By creating an account or using the Service in any way you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@resume-ats.online if you believe your account has been compromised.

You may not create accounts using automated means, share your account with others, or create multiple accounts to circumvent plan limits or bans.

3. Description of Service

ResumePass provides:

  • ATS compatibility scoring of resumes against job descriptions
  • Keyword gap analysis and resume optimization suggestions
  • AI-powered resume rewriting
  • Resume template downloads (PDF and DOCX)
  • Job search and job-to-resume fit scoring
  • Cover letter generation
  • Application tracking

We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice where practicable.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Submit content that infringes the intellectual property rights of any third party
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Service
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure
  • Use the Service to generate false, misleading, or fraudulent application materials
  • Circumvent any rate limits, usage caps, or access controls implemented in the Service
  • Resell, sublicense, or provide the Service to third parties without our written consent

5. Your Content

You retain ownership of the resumes, job descriptions, and other content you submit ("Your Content"). By submitting Your Content you grant us a limited, non-exclusive license to process it solely to provide the Service to you. We do not claim ownership of Your Content and do not use it to train AI models beyond processing your individual request.

You represent that you have the right to submit Your Content and that it does not violate any law or third-party rights. You are solely responsible for the accuracy and legality of Your Content.

6. AI-Generated Output

The Service uses AI to generate resume rewrites, scores, cover letters, and other suggestions. AI output is provided for informational purposes only. It may contain errors, inaccuracies, or omissions. You are responsible for reviewing and editing all AI-generated content before using it in job applications or elsewhere. We make no guarantee that using the Service will result in job interviews or employment.

7. Subscriptions and Payment

Billing

Paid plans are billed on a recurring monthly basis via Stripe. By subscribing you authorize us to charge your payment method on each billing date until you cancel.

Free trial

Students who verify a .edu email address receive a 1-week trial of the Hustler plan at no charge. At the end of the trial your plan reverts to the free tier unless you subscribe. We will not charge you without prior notice.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refunds

We offer a 7-day money-back guarantee on your first paid month. If you are not satisfied, contact support@resume-ats.online within 7 days of your first charge and we will issue a full refund. Subsequent billing periods are non-refundable except where required by law.

Price changes

We may change subscription prices with at least 30 days' advance notice. Continued use after the notice period constitutes acceptance of the new price.

8. Intellectual Property

All content, design, code, trademarks, and other materials on the Service (excluding Your Content) are owned by ResumePass or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

9. Third-Party Services

The Service integrates with third-party platforms including Stripe (payments) and AI providers (Anthropic, OpenAI). Your use of those integrations is also subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RESUMEPASS, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

12. Indemnification

You agree to defend, indemnify, and hold harmless ResumePass and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or if required by law. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ends immediately. Sections 5, 8, 10, 11, 12, and 15 survive termination.

14. Changes to These Terms

We may update these Terms at any time. When we do we will update the "Last updated" date at the top of this page. For material changes we will provide at least 14 days' notice by email or via a prominent in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute arising under these Terms shall be resolved through binding arbitration administered under the rules of the American Arbitration Association, conducted in English in Florida. Each party waives the right to a jury trial and to participate in class-action proceedings. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction in Florida.

16. Miscellaneous

  • Entire agreement — These Terms and our Privacy Policy constitute the entire agreement between you and ResumePass regarding the Service.
  • Severability — If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
  • No waiver — Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment — You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
